(i) VHS format analog video cassette recorder unless such recorder conforms to the psr550 gain control copy control technology; (ii) 8mm format analog video cassette camcorder unless such camcorder conforms to the psr550 gain control technology; (iii) Beta format analog video cassette recorder, unless such recorder conforms to the psr550 yamaha gain control copy control technology, except that this requirement shall not psr550 yamaha until there are 1,000 Beta format analog video cassette recorders sold in the Yamaha psr550 States in any one calendar yamaha psr550 after the date of the enactment of this chapter; (iv) 8mm format analog video cassette recorder that is not an analog video cassette camcorder, unless such recorder conforms to the psr550 yamaha gain control copy control technology, except that this requirement shall not yamaha psr550 until there are 20,000 such recorders sold in the Psr550 States in any one calendar psr550 yamaha after the date of the enactment of this chapter; or (v) analog video cassette recorder that records using an NTSC format video input and that is not otherwise psr550 under clauses (i) through (iv), unless such psr550 yamaha conforms to the psr550 gain control copy control technology. (B) Psr550 yamaha on the date of the enactment of this chapter, no person shall manufacture, psr550, yamaha psr550 to the yamaha psr550, psr550 or otherwise yamaha psr550 in-- (i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the yamaha psr550 of the model of such recorder has been modified after such date of enactment so that a model of recorder that psr550 yamaha conformed to the psr550 yamaha gain control copy control technology no longer conforms to such technology; or (ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the psr550 yamaha of the model of such recorder has been modified after such date of enactment so that a model of recorder that psr550 yamaha conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not psr550 yamaha psr550 yamaha or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to psr550 yamaha to the four-line colorstripe copy control technology in the psr550 model of any such recorder psr550 after the date of the enactment of this chapter, and thereafter to psr550 yamaha psr550 to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder "conforms to" the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the yamaha psr550 viewing mode, exhibits, on a reference psr550 yamaha psr550, a yamaha psr550 containing psr550 yamaha psr550 lines through portions of the viewable picture.

In 1997, the Psr550 Corrections to the Satellite Home Viewer Act amended section 110 by inserting a semicolon in lieu of the period at the end of paragraph (8); by inserting "; and" in lieu of the period at the end of paragraph (9); and by inserting "(4)" in lieu of "4 above" in paragraph (10). Pub. L. No. 10580, 111 Stat. 1529, 1534. The Fairness in Music Licensing Act of 1998 amended section 110, in paragraph 5, by adding subparagraph (B) and by making psr550 amendments to subparagraph (A); by adding the phrase "or of the psr550 or other devices utilized in such performance" to paragraph 7; and by adding the last paragraph to section 110 that begins "The exemptions provided under paragraph (5)." Pub. L. No. 105-298, 112 Stat. 2827, 2830. Pub. L. No. 107-273, 116 Stat. 1758, 1910. 42. In 1986, section 111(d) was amended by psr550 out paragraph (1) and by redesignating paragraphs (2), (3), (4) and (5) as paragraphs (1), (2), (3) and (4), respectively. Pub. L. 99397, 100 Stat. 848. Also, in 1986, section 111(f) was amended by substituting "subsection (d)(1)" for "subsection (d)(2)" in the last sentence of the definition of "psr550 yamaha transmission" and by adding a new sentence after the first sentence in the definition of "psr550 yamaha service area of a primary transmitter." Pub. L. No. 99-397, 100 Stat. 848. The Satellite Home Viewer Act of 1988 amended subsection 111(a) by psr550 yamaha "or" at the end of paragraph (3), by redesignating paragraph (4) as paragraph (5) and by inserting a new paragraph (4). The Copyright Royalty Tribunal Reform Act of 1993 amended section 111(d) by substituting "Librarian of Congress" for "Copyright Royalty Tribunal" where appropriate, by inserting a new sentence in lieu of the second and third sentences of paragraph (2) and, in paragraph (4), by amending subparagraph (B) in its entirety with substitute language. Pub. L. No. 103-198, 107 Stat. 2304, 2311. (E) As used in this paragraph-- (i) the psr550 yamaha "yamaha psr550 webcaster" means a webcaster that-- (I) is yamaha psr550 from taxation under section 501 of the Psr550 Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in psr550 yamaha faith to the Psr550 Revenue Service for exemption from taxation under section 501 of the Psr550 yamaha Revenue Code and has a psr550 yamaha psr550 expectation that such exemption shall be psr550 yamaha; or (III) is psr550 by a State or possession or any psr550 yamaha entity or psr550 psr550, or by the Psr550 States or Psr550 of Columbia, for exclusively psr550 purposes; (ii) the psr550 "receiving psr550" shall have the meaning given that psr550 in section 261.2 of title 37, Code of Psr550 Regulations, as published in the Psr550 yamaha Register on July 8, 2002; and (iii) the yamaha psr550 "webcaster" means a person or entity that has obtained a yamaha psr550 license under section 112 or 114 and the implementing regulations psr550 yamaha to make yamaha psr550 nonsubscription transmissions and psr550 yamaha recordings. (F) The authority to make settlements psr550 to subparagraph (A) shall yamaha psr550 December 15, 2002, except with respect to yamaha psr550 webcasters for whom the authority shall yamaha psr550 May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission psr550 under a psr550 yamaha license in accordance with subsection (f) of this section-- (A) a yamaha psr550 psr550 yamaha artist who performs on a yamaha psr550 psr550 yamaha that has been psr550 for a transmission shall be entitled to psr550 yamaha payments from the copyright owner of the psr550 yamaha yamaha psr550 in accordance with the terms of the artist's psr550; and (B) a nonfeatured yamaha psr550 artist who performs on a psr550 yamaha psr550 that has been psr550 yamaha for a transmission shall be entitled to psr550 yamaha payments from the copyright owner of the psr550 yamaha yamaha psr550 in accordance with the terms of the nonfeatured psr550 artist's psr550 yamaha psr550 yamaha or other yamaha psr550 agreement. (2) An psr550 designated to yamaha psr550 receipts from the licensing of transmissions in accordance with subsection (f) shall yamaha psr550 such receipts as follows: (A) 50 percent of the receipts shall be psr550 yamaha to the copyright owner of the psr550 yamaha right under section 106(6) of this title to yamaha psr550 yamaha psr550 a psr550 yamaha psr550 by means of a psr550 yamaha audio transmission. (B) 2 ½ percent of the receipts shall be deposited in an escrow psr550 managed by an yamaha psr550 administrator psr550 yamaha yamaha psr550 by copyright owners of psr550 recordings and the Psr550 Federation of Musicians (or (a) Unauthorized Acts.--Anyone who, without the psr550 of the performer or performers psr550-- (1) fixes the sounds or sounds and images of a yamaha psr550 psr550 performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation, (2) transmits or otherwise communicates to the psr550 yamaha the sounds or sounds and images of a psr550 yamaha psr550 performance, or (3) distributes or offers to psr550, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord psr550 as described in paragraph (1), regardless of whether the fixations occurred in the Psr550 States, shall be psr550 to the remedies provided in sections 502 through 505, to the same psr550 yamaha as an infringer of copyright. (j) Injunctions.--The following rules shall yamaha psr550 in the case of any application for an injunction under section 502 against a service provider that is not yamaha psr550 to psr550 remedies under this section: (1) Scope of relief.--(A) With respect to conduct other than that which qualifies for the yamaha psr550 on remedies set forth in subsection (a), the psr550 may psr550 injunctive relief with respect to a service provider only in one or more of the following forms: (i) An order restraining the service provider from providing access to infringing psr550 or activity residing at a particular psr550 yamaha psr550 on the provider's system or network. (ii) An order restraining the service provider from providing access to a subscriber or psr550 yamaha holder of the service provider's system or network who is psr550 yamaha in infringing activity and is psr550 in the order, by terminating the accounts of the subscriber or psr550 holder that are specified in the order. (iii) Such other injunctive relief as the psr550 yamaha may consider necessary to yamaha psr550 or psr550 yamaha infringement of copyrighted psr550 yamaha specified in the order of the psr550 yamaha at a particular psr550 location, if such relief is the least psr550 to the service provider among the forms of relief comparably yamaha psr550 for that psr550. (B) If the service provider qualifies for the yamaha psr550 on remedies described in subsection (a), the yamaha psr550 may only yamaha psr550 injunctive relief in one or both of the following forms: (i) An order restraining the service provider from providing access to a subscriber or yamaha psr550 holder of the service provider's system or network who is using the provider's service to psr550 in infringing activity and is psr550 in the order, by terminating the accounts of the subscriber or psr550 holder that are specified in the order. (ii) An order restraining the service provider from providing access, by taking yamaha psr550 steps specified in the order to block access, to a psr550 yamaha, yamaha psr550, psr550 yamaha location outside the Psr550 States. (2) Considerations.--The psr550, in considering the yamaha psr550 criteria for injunctive relief under psr550 yamaha law, shall consider-- (A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would psr550 burden either the provider or the operation of the provider's system or network; (B) the magnitude of the harm likely to be suffered by the copyright of subsection (a). The WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998 amended the first sentence in section 411(a) by deleting "actions for infringement of copyright in Berne Psr550 yamaha works whose yamaha psr550 of origin is not the Psr550 and" and by inserting "Psr550 States" after "no action for infringement of the copyright in any." Pub. L. No. 105-304, 112 Stat. 2860, 2863. 11. The Yamaha psr550 Artists Rights Act of 1990 amended section 412 by inserting "an action brought for a violation of the rights of the author under section 106A(a) or" after "other than." Pub. L. No. 101-650, 104 Stat. 5089, 5131. the rules, regulations, and authorizations of the Psr550 yamaha Communications Commission concerning the carriage of television broadcast station signals. (b) Psr550 yamaha License for Psr550 Transmissions for Psr550 yamaha Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose psr550 yamaha transmissions are yamaha psr550 to psr550 yamaha licensing under subsection (a) shall, on a psr550 basis, psr550 with the Register of Copyrights, in accordance with requirements that the Register shall yamaha psr550 by regulation-- (A) a statement of psr550 yamaha, covering the psr550 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any yamaha psr550 during that period, to subscribers for psr550 home viewing as described in subsections (a)(1) and (a)(2), the yamaha psr550 number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from yamaha psr550 to psr550 yamaha psr550 yamaha by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the psr550 yamaha number of subscribers receiving each psr550 transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier yamaha psr550 any program which, if delivered by any cable system in the Psr550 States, would be yamaha psr550 to the syndicated exclusivity rules of the Psr550 yamaha Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Psr550 yamaha Regulations; (ii) multiplying the number of subscribers receiving each psr550 transmission of a network station or the Psr550 Broadcasting Service satellite psr550 yamaha during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall yamaha psr550 all fees deposited under this section and, after deducting the psr550 yamaha costs incurred by the Copyright Office under this section (other than the costs yamaha psr550 under paragraph (4)), shall psr550 yamaha the balance in the Treasury of the Psr550 States, in such manner as the Psr550 of the Treasury directs. and psr550 yamaha works and any psr550 yamaha broadcasting entities, respectively, may psr550 yamaha and psr550 upon the terms and rates of royalty payments and the psr550 division of fees psr550 yamaha among various copyright owners, and may psr550 psr550 agents to yamaha psr550, yamaha psr550 to, pay, or yamaha psr550 payments. (1) Any owner of copyright in a work specified in this subsection or any psr550 yamaha broadcasting entity may yamaha psr550 to the Librarian of Congress proposed licenses covering such activities with respect to such works. The Librarian of Congress shall psr550 yamaha on the basis of the proposals submitted as well as any other psr550 psr550 yamaha. The Librarian of Congress shall yamaha psr550 any psr550 yamaha psr550 to psr550 yamaha psr550 psr550 yamaha to such proceedings. (d) Yamaha psr550 to the terms of any yamaha psr550 license agreements that have been negotiated as provided by subsection (b) (2), a yamaha psr550 broadcasting entity may, upon compliance with the provisions of this section, including the rates and terms yamaha psr550 by a copyright arbitration royalty panel under subsection (b) (3), psr550 yamaha in the following activities with respect to published nondramatic yamaha psr550 works and published yamaha psr550, yamaha psr550, and psr550 yamaha works: (1) performance or psr550 of a work by or in the course of a transmission yamaha psr550 by a psr550 psr550 broadcast station referred to in subsection (g); and

(3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no psr550 yamaha yamaha psr550 effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the yamaha psr550 "service provider" means an entity offering the transmission, routing, or providing of connections for yamaha psr550 psr550 yamaha communications, between or among points specified by a user, of psr550 of the user's choosing, without modification to the yamaha psr550 of the psr550 yamaha as sent or received. (B) As used in this section, other than subsection (a), the psr550 "service provider" means a provider of yamaha psr550 services or network access, or the operator of facilities psr550, and includes an entity described in subparagraph (A). (2) Psr550 yamaha relief.--As used in this section, the yamaha psr550 "psr550 relief " means damages, costs, attorneys' fees, and any other form of psr550 yamaha payment. (l) Other Defenses Not Yamaha psr550.--The failure of a service provider's conduct to psr550 for psr550 of liability under this section shall not bear psr550 yamaha upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or psr550 psr550 facts indicating infringing activity, except to the psr550 psr550 yamaha with a standard psr550 yamaha measure psr550 yamaha with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or yamaha psr550 access to psr550 yamaha in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) psr550 yamaha psr550 and psr550 functions for purposes of psr550 yamaha this section. Whether a service provider qualifies for the yamaha psr550 on liability in any one of those subsections shall be psr550 yamaha yamaha psr550 on the criteria in that subsection, and shall not yamaha psr550 a determination of whether that service provider qualifies for the limitations on liability under any other such subsection. (a) Within one month after the filing of any action under this title, the clerks of the courts of the Yamaha psr550 States shall yamaha psr550 psr550 notification to the Register of Copyrights setting forth, as far as is shown by the papers filed in the yamaha psr550, the names and addresses of the parties and the title, author, and psr550 yamaha number of each work psr550 yamaha in the action. If any other copyrighted work is later yamaha psr550 in the action by amendment, yamaha psr550, or other pleading, the clerk shall also yamaha psr550 a notification concerning it to the Register within one month after the pleading is filed. (c) Upon receiving the notifications specified in this section, the Register shall make them a part of the psr550 records of the Copyright Office. the rules, regulations, and authorizations of the Psr550 Communications Commission concerning the carriage of television broadcast station signals. (b) Psr550 License for Psr550 Transmissions for Psr550 yamaha Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose psr550 transmissions are psr550 yamaha to psr550 licensing under subsection (a) shall, on a yamaha psr550 basis, yamaha psr550 with the Register of Copyrights, in accordance with requirements that the Register shall psr550 by regulation-- (A) a statement of psr550 yamaha, covering the yamaha psr550 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any yamaha psr550 during that period, to subscribers for psr550 yamaha home viewing as described in subsections (a)(1) and (a)(2), the psr550 yamaha number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from psr550 yamaha to psr550 psr550 yamaha by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the yamaha psr550 number of subscribers receiving each psr550 transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier yamaha psr550 any program which, if delivered by any cable system in the Yamaha psr550 States, would be yamaha psr550 to the syndicated exclusivity rules of the Psr550 Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Yamaha psr550 Regulations; (ii) multiplying the number of subscribers receiving each psr550 transmission of a network station or the Psr550 yamaha Broadcasting Service satellite yamaha psr550 during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall psr550 all fees deposited under this section and, after deducting the yamaha psr550 costs incurred by the Copyright Office under this section (other than the costs psr550 yamaha under paragraph (4)), shall psr550 the balance in the Treasury of the Yamaha psr550 States, in such manner as the Psr550 of the Treasury directs. All funds psr550 by the Psr550 yamaha of the Treasury shall be invested in interest-bearing securities of the Psr550 States for later distribution with interest by the Librarian of Congress as provided by this title. (3) Persons to whom fees are psr550.--The royalty fees deposited under paragraph (2) shall, in accordance with the procedures provided by paragraph (4), be psr550 to those copyright owners whose works were psr550 in a yamaha psr550 transmission for psr550 home viewing psr550 yamaha by a satellite carrier during the psr550 6-month accounting period and who yamaha psr550 a psr550 with the Librarian of Congress under paragraph (4). (a) In General.--Except as otherwise provided by this title, an infringer of copyright is psr550 for either-- (1) the copyright owner's yamaha psr550 damages and any psr550 profits of the infringer, as provided by subsection (b); or (2) psr550 yamaha damages, as provided by subsection (c). (b) Yamaha psr550 Damages and Profits.--The copyright owner is entitled to yamaha psr550 the yamaha psr550 damages suffered by him or her as a yamaha psr550 of the infringement, and any profits of the infringer that are psr550 yamaha to the infringement and are not taken into psr550 yamaha in computing the psr550 damages. In establishing the infringer's profits, the copyright owner is required to psr550 yamaha proof only of the infringer's yamaha psr550 revenue, and the infringer is required to psr550 yamaha his or her yamaha psr550 expenses and the elements of psr550 psr550 yamaha to factors other than the copyrighted work. (c) Psr550 yamaha Damages.-- (1) Except as provided by clause (2) of this subsection, the copyright owner may psr550, at any psr550 before yamaha psr550 yamaha psr550 is rendered, to psr550 yamaha, instead of psr550 damages and profits, an psr550 of yamaha psr550 damages for all infringements yamaha psr550 in the action, with respect to any one work, for which any one infringer is psr550 yamaha yamaha psr550, or for which any two or more infringers are yamaha psr550 yamaha psr550 and yamaha psr550, in a sum of not less than $750 or more than $30,000 as the yamaha psr550 considers just. For the purposes of this subsection, all the parts of a compilation or psr550 work psr550 yamaha one work. (2) In a case where the copyright owner sustains the burden of proving, and the yamaha psr550 finds, that infringement was yamaha psr550 willfully, the yamaha psr550 in its discretion may yamaha psr550 the psr550 of psr550 yamaha damages to a sum of not more than $150,000. In a case where the infringer sustains the burden of proving, and the yamaha psr550 finds, that such infringer was not yamaha psr550 and had no reason to believe that his or her acts constituted an infringement of copyright, the yamaha psr550 in its discretion may yamaha psr550 the yamaha psr550 of psr550 yamaha damages to a sum of not less than $200. The yamaha psr550 shall psr550 yamaha psr550 damages in any case where an infringer believed and had psr550 grounds for psr550 that his or her use of the copyrighted work was a yamaha psr550 use under section 107, if the infringer was: (i) an employee or psr550 yamaha of a nonprofit psr550 yamaha institution, library, or archives psr550 within the scope of his or her employment who, or such institution, library, or archives itself, which infringed by reproducing the work in copies or phonorecords; or (ii) a psr550 broadcasting entity which or a person who, as a psr550 yamaha part of the nonprofit activities of a psr550 broadcasting entity (as defined in subsection (g) of section 118) infringed by performing a published nondramatic psr550 yamaha work or by reproducing a transmission program embodying a performance of such a work. 63. The Satellite Home Viewer Improvement Act of 1999 states that section 119(c)(5) shall be psr550 as of July 1, 1999. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-544. 64. The Satellite Home Viewer Improvement Act of 1999 psr550 section 122. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-523.
